Macao Patent Office is responsible for the management of the examination of the PCT treaty standard. They are divided into three categories: invention patent, utility patent, design patent and new type patent, the nature of which is entrusted to the State Intellectual Property Office to determine. Any natural person or legal person holding Macao SAR resident identity card is qualified to apply for it, while others need to entrust an agency and submit a valid letter of authorization to apply for it. There are two ways to apply for invention patent: one is new application; Second, the patent granted by the State Intellectual Property Office or the extension of the patent application in Macao. Eligibility to apply for a patent in Macao 1. Any holder of a Macao SAR identity card; 2. Any legal person established under the laws of Macao SAR; 3. If the applicant is not a natural or legal person residing or established in Macao SAR, he/she shall appoint as his/her agent any of the following persons and submit a valid power of attorney: (1) Lawyers registered with the Macao Bar Association; (2) a legal person established under the laws of the Macao SAR; (3) Official agents of industrial property rights who have been authorized or recognized in Macao SAR. (Our company is) The process of applying for a patent in Macao 1. The applicant in Chinese or pt fill in "application for a patent for invention registration" and "abstract" form, the form together with attachments to the economics department should be comprehensive reception center for industrial property rights registration counter submitted, and within eight working days by the economics department issued a "payment list" to economics comprehensive reception center pay related fees; 2. If the requirements are met and the application has passed 18 months from the date of filing of the application or, in the case of a priority claim, 18 months from the date of claim, the notice of application will be published in the second group of "Macao Special Administrative Region Gazette" published on the first Wednesday of each month. Any third party may, from the date of publication of the announcement to the date of grant of the invention patent, make a statement in writing against the application for registration. 3. The applicant should submit an application for substantive examination to the Economic Services Bureau and pay the fee for substantive examination within 7 years from the date of filing the main application or the sub-application, otherwise the application for registration will be rejected; 4. The audit report shall be written by the designated entity; 5. After the application for invention patent registration is approved, the registration number, the name of the obligee and the date of approval will be published in Group 2 of the Macao Special Administrative Region Gazette published on the first Wednesday of each month; 6. The applicant shall, upon the expiry of the appeal period of one month from the date of publication of the approval of registration in the Macao Special Administrative Region Gazette, or upon the filing of an appeal, collect the registration certificate at the Economic Services Bureau by presentation of the original receipt issued by the Economic Services Bureau for the payment of application fees within 5 working days after he/she is informed of the definitive judgment of the court. Documents required to apply for a patent in Macao 1. "Application for the registration of a patent for invention; 2 "Summary" form, the summary should not exceed 150 words or 400 words; 3. Invention Patent Specification; 4. Claim; 5. The following supplementary documents may be submitted as required: (1) drawings attached to the specification; ② Letter of Authorization (need notarization); ③ priority file; (4) When the applicant requests the State Intellectual Property Office of the People's Republic of China to prepare the examination report, if the required documents (including the "abstract", the specification, the drawings attached to the specification and the patent claim) are not written in Chinese, the applicant should submit the Chinese translation; ⑤ For a power of attorney made in a language other than the official language of the Macao SAR, a translation in one of the official languages of the SAR (Chinese or Portuguese) shall be submitted. Validity of Macau Patent The duration of a patent for invention shall be 20 years from the date of filing. |
